Abstract

Penelitian ini bertujuan untuk menganalisis apa saja yang menjadi faktor-faktor viktimisasi terhadap korban penipuan melalui media sosial dan bagaimana bentuk perlindungan hukum terhadap korban penipuan melalui media sosial. Penelitian ini merupakan jenis penelitian hukum normatif dengan menggunakan pendekatan konseptual, pendekatan undang-undang, dan pendekatan kasus. Penelitian ini menemukan bahwa Pertama, faktor yang menyebabkan korban tersebut menjadi korban penipuan media sosial ialah target yang sesuai (suitable target), ketiadaan penjagaan yang memadai (absence of capable guardians) dan pelaku yang termotivasi (motivated offenders) dilihat dari status ekonomi dan aktivitas sosial dengan media digital/online yang tanpa sadar membuat diri menjadi korban kejahatan media sosial. Kedua, bentuk perlindungan korban tindak pidana penipuan dari Kitab Undang-Undang Hukum Pidana maupun Undang-Undang Nomor 19 Tahun 2016 tentang perubahan atas Undang- Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Perlindungan korban dapat di tempuh melalui prosedur yang telah ditentukan, OJK, KOMINFO, dan LPSK.
