Abstract

Peradilan in absentia dalam perkara tindak pidana korupsi telah difasilitasi oleh beberapa undang-undang, sepertu Undang-Undang Nomor 31 Tahun 1999 Jo Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, Pasal 38 Ayat 1 berbunyi; “Dalam hal terdakwah telah dipanggil secara sah, tidak hadir di sidang pengadilan tanpa alasan yang yang sah maka perkara dapat diperiksa dan diputus tanpa kehadirannya. Pemberantasan tindak pidana korupsi tidak hanya berbicara mengenai penangan ataupun pemeriksaan terdakwa di muka persidangan, serta pengembalikan kerugian keuangn negara atau perekonomian negara yany timbul dari tindak pidana korupsi. Adapun jenis penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian adalah Terdapat beberapa bentuk langkah penegakkan hukum pidana dalam mengembaliaan asset kekayaan yaitu Pembuktian Terbalik Dalam Rangka Optimalisasi Pengembalian Aset Hasil Tindak Pidana Korupsi, Pengembalian Aset Hasil Tindak Pidana Korupsi Melalui Gugatan Perdata, Pidana Pembayaran Uang Pengganti Dalam Rangka Pengembalian Aset Hasil Tindak Pidana Korupsi.
