Abstract

Penyitaan ditujukan untuk kepentingan "pembuktian" terutama sebagai barang bukti dimuka sidang peradilan. Berdasarkan Pasal 44 KUHAP, maka benda sitaan disimpan dalam Rumah Penyimpanan Benda Sitaan Negara. Dalam Rupbasan, penyimpanan benda sitaan seharusnya dilaksanakan dengan sebaik-baiknya dan tanggung jawab atasnya ada pada pejabat yang berwenang sesuai dengan tingkat pemeriksaan dalam proses peradilan dan benda tersebut dilarang untuk dipergunakan oleh siapapun juga, namun masih saja terdapat benda-benda sitaan yang hilang atau raib. Tujuan penelitian ini adalah untuk mengkaji tanggung jawab Rupbasan terhadap benda sitaan negara yang berada di Rupbasan. Metode penelitian yang digunakan adalah penelitian normatif, dengan menggunakan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa bentuk tanggung jawab Kepala Rupbasan terhadap benda sitaan, yaitu tanggung jawab secara fisik, tanggung jawab terhadap pemeliharaan benda sitaan, tanggung jawab terhadap pengamanan dan keselamatan benda sitaan, tanggung jawab secara perdata, administrasi dan pidana terhadap benda sitaan yang berada di Rupbasan.
