Abstract

Perbankan syariah di Indonesia saat ini berkembang dengan pesat. Seiring dengan perkembangan tersebut, dibutuhkan dukungan hukum (legal support) terhadap perbankan syariah dari berbagai aspek, salah satunya dalam hal penyelesaian sengketa. Penyelesaian sengketa dalam dunia perbankan dapat diselesaikan melalui dua jalur penyelesaian yaitu jalur litigasi (pengadilan) dan jalur diluar pengadilan (non litigasi). Perkembangan penyelesaian sengketa non litigasi tersebut seiring perkembangan teknologi kemudian menghadirkan mekanisme alternatif penyelesaian sengketa berupa Online Dispute Resolution. Tujuan penelitian ini adalah untuk mengkaji landasan sosiologis Online Dispute Resolution sebagai Alternatif Penyelesaian Sengketa dan masa depan penyelesaian sengketa perbankan syariah melalui Online Dispute Resolution. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan konseptual. Beberapa regulasi di Indonesia masih belum dapat mengakomodir penyelesaian sengketa di sektor perbankan syariah melalui mekanisme Online Dispute Resolution. Oleh karena itu diperlukan pembaharuan hukum guna menjamin kepastian hukum dan rasa keadilan pada masyarakat, khususnya nasabah. Terlebih Online Dispute Resolution memiliki banyak kelebihan, salah satunya adalah tidak perlu adanya proses penyelesaian sengketa secara tatap muka dan dapat dilakukan secara fleksibel.
